INFORMED CONSENT AND GENERAL RELEASE

I, _____________________________________, have consented to participate in a fitness program provided to me by Remix Fitness and it’s instructors, which may include the use of exercise equipment, resistance training, and aerobic or cardiovascular exercise.

In consideration of Remix Fitness’s agreement to instruct and train me, and intending to be legally bound, I, for myself, my heirs, personal representatives, and assigns, do hereby release, waive, and hold harmless Remix Fitness, LLC and their respective members/directors, officers, instructors, agents, employees, heirs, successors and assigns, (collectively, the “Releasees”), from any and all claims, actions, suits, demands, proceedings, costs, expenses, damages, and liabilities, whether caused by the active or passive negligence, gross negligence, recklessness, or intentional acts of Releasees, to the fullest extent permitted by law, arising out of or relating in any way to my participation in the fitness program, including injuries arising from use by me or others of exercise equipment and machines; injuries arising from participation by me or others in supervised or unsupervised activities or programs; injuries and medical disorders arising from my participation in the fitness program; and accidental injuries occurring at any facilities used in connection with the fitness program and/or travel before, during, or after my participation in the fitness program. I further agree to indemnify and hold harmless Releasees from any and all claims, actions, suits, demands, proceedings, costs, expenses, damages, and liabilities, including attorneys’ fees, and to reimburse Releasees for any such expense incurred in connection with or as a result of my participation in the fitness program, or travel before, during, or after my participation in the fitness program.

I have been informed of, understand, and am aware that any fitness program, whether or not requiring the use of exercise equipment, is a potentially hazardous activity. I also have been informed of, understand, and am aware that any exercise and/or fitness activities involve a risk of injury, as well as a risk of abnormal changes in blood pressure, fainting, and a risk of heart attack, stroke, other serious disability or death, and that I am voluntarily participating in these activities and using equipment and machinery with full knowledge, understanding, and appreciation of the dangers and risks involved. I hereby agree to expressly assume and accept any and all risks of injury, regardless of severity, or death. I have been advised that an examination by a physician should be obtained by anyone prior to commencing a fitness and/or exercise program, or initiating a substantial change in the amount of regular physical activity performed. If I have chosen not to obtain a physician’s consent prior to beginning this fitness program with Instructor, I hereby agree that I am doing so solely at my own risk.

I also give Remix Fitness permission to use my name, likeness, image, voice, and/or appearance as such may be embodied in any pictures, photos, video recordings, audiotapes, digital images, and the like, taken or made on behalf of Remix Fitness activities. I agree that Remix Fitness has complete ownership of such pictures, etc., including the entire copyright, and may use them for any purpose consistent with Remix Fitness missions. These uses include, but are not limited to illustrations, bulletins, exhibitions, videotapes, reprints, reproductions, publications, advertisements, and any promotional or educational materials in any medium now known or later developed, including the Internet. I acknowledge that I will not receive any compensation, etc for the use of such pictures, etc., and hereby release Remix Fitness and its agents and assigns from any and all claims which arise out of or are in any way connected with such use.

I HAVE READ THIS DOCUMENT IN ITS ENTIRETY, FULLY UNDERSTAND ITS TERMS, AND UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL RIGHTS—INCLUDING MY RIGHT TO SUE. I ACKNOWLEDGE THAT I AM SIGNING THIS DOCUMENT FREELY AND VOLUNTARILY AND INTEND, BY MY SIGNATURE, THAT THE FOREGOING RELEASE, WAIVER, AND INDEMNITY AGREEMENT BE AS BROAD AND INCLUSIVE AS IS PERMITTED BY THE LAW OF THE COMMONWEALTH OF PENNSYLVANIA AND THAT IF ANY PORTION THEREOF IS HELD INVALID, THE BALANCE SHALL, NOTWITHSTANDING, CONTINUE IN FULL FORCE AND EFFECT.
